Terms & Conditions Explained
These are our Terms and Conditions as at December 2009. Work requested by the client verbally or written constitutes agreement to these Terms & Conditions.
Price
Web site design, graphic design, photographic editing and consultancy work will be charged at £20phr (This is our normal hourly rate).
unless:
A) A quote has been submitted for the entire job (Follow up work after completion will be charged at our normal hourly rate unless otherwise stated).
or
B) A request for work out of office hours, or work of such urgency that it interrupts our normal workflow. An extra cost will be incurred for this service. Work of this nature will be charged at £30phr (Notice of this charge will be given before the work commences).
Payment Schedule & Conditions
For work carried out under our hourly rate:
First payment of £300 (Deposit) or an initial percentage of the foreseen total costs will be due before any work commences. Further invoices will be presented at approximately £400.00 intervals. You will have two weeks to pay these invoices.
For quoted work:
A deposit of 40% of the costs will be required before any of the work commences. The remainder will be paid during the final stages of the works completion.
Cancellations
Cancellation by the client of work already commenced by Magic Beans The Creative Design Company, will result in a cancellation charge based on the time spent on the work. Surplus monies will be refunded.
Penalties
Until contract is completed and paid for in full, all design work remains the intellectual property of Magic Beans The Creative Design Company. In the case of web sites this means that we reserve the right to remove from the internet any web site designed by us or altered by us that has not been paid for in full.
Work will not proceed if invoice remains unpaid. Failure to pay an invoice; one month from the original invoiced date, will result in a £50 surcharge. £50 will be applied every month for 3 months thereafter if invoice remains unpaid. Absolute failure to pay will result in legal proceedings.
Design work not paid for will be destroyed after 3 months of initial unpaid invoice.
Payments made electronically must be paid in the exact invoice amount. Only one invoice can be cleared per transaction. Exceptions are made only upon request. Failure to adhere to these rules will result in a £50 surcharge per transaction error.
Refunds
For quoted work:
Refunds are only available when Magic Beans The Creative Design Company fails to supply what was agreed, in writing.
For work carried out under our hourly rate:
Magic Beans The Creative Design Company will refund surplus monies of advanced payments. Refunds will not be given for any part of the work already completed.

Magic Beans The Creative Design Company reserves the right to change the above terms and conditions. In the unlikely event that changes are made, you will be given one months notice in advance.
